^Yeah, this does seem like a case for an exception. I don't understand the height restriction, this isn't a flight path to downtown airport is it?

Yes. I've run into them on projects over near the Blue River/Manchester... which is AFAIK near no airports. Their application process is impossible.

You keep saying that, but where is that requirement in the process? Even if it's just to satisfy voters, put it in the process and then manage it that way.

The Developer did everything asked of them. They had signed letters of support and then were denied based on a new set of parameters. I mean, what do you want from them? You can't keep moving goal posts on developers and expect them to keep trying

^Yeah like I said this should be an exception but there probably should be a requirement added to process for TOD locations to have broader public engagement if wanting 25 year abatement. Also, this one was submitted well before the incentives requirement changes right? So should be granted. Mayor Q should step in on this one.

yea, i agree that the only reason this should be allowed full 25 yrs is b/c it is grandfathered and b/c of site difficulties/prioritization by city. Otherwise, need to follow current requirements. Reducing the term of abatements overall is a good idea.

If you all didn't know, there is a TOTAL MESS of utilities at this site. You name it, it's underground here. And it's absolutely the truth the city showed up with the bike lane requirement at the last minute and forced the developer to figure out how to shift the entire site plan east to accommodate the connection the new Grand bike/ped bridge (which exists only because of the riverfront streetcar extension).

Did we not know the utilities were down there when the plan to develop this lot was decided and the developer agreed?

Only what the streetcar uncovered and mapped in the 3rd & Grand intersection.

I feel for the developer but they were also fully aware of the site then. Seems like a few tweaks can get this done.

From a couple experiences in downtown, it isn't uncommon for the city to not know exact underground utility locations.

I mean, it’s definitely not where it has been, and other groups are gaining influence that have following enough to kill projects. This is a great victory though!
