But U.S. District Court Judge Greg Kays ruled Chastain had failed to establish any of the statements as false and noted Chastain acknowledged some of the statements in the very court filing where he claimed they weren’t true.

Putting this on the November ballot seems like it would be a fantastic way to get free survey data for a legitimate future transit proposal.

Except people who would normally support and official proposal would be telling voters to vote no. Trust me, we made the same mistake when Chastain's previous proposal was generic enough to be hijacked so KCRTA (which I led at the time) thought "oh, yeah, let's try telling people to vote yes on this." They didn't.

Clay Chastain is well intentioned (or was originally?) but absolutely toxic. Tom Gerand/Dave and others are the actual people working on real transit, which means $$ for MAX and Streetcar Phase II.

Depends on one's definition of well intention-ed. He was pro transit, I will give him that, but his first appearance on the scene was to oppose the BiState effort at Union Station on the grounds it should be preserved only as a transit hub. Even the streetcar was still years away at that point and Union Station was falling into disrepair; there was no way voters would approve the rehabilitation of the Station for a transit hub. His defeat left him bitter and it showed in every subsequent attempt to get a transportation project passed. His transit proposal that passed (like the others that did not), had the light rail route going through unpopulated and un-visited Penn Valley Park solely because it would then be in a position to require the destruction of Science City as it passed through Union Station. To me, he was full of hidden agendas and he had scores to settle which made it impossible for him to be a real champion for light rail in KC.
