When is the county in default of the lease?

Post by KCMax »

The KC Star finally clears it up:

■ The county’s current predicament.

Albert Riederer, a former Jackson County prosecutor and one of the civic co-chairmen of the stadium renovations campaign, told a Blue Springs Chamber of Commerce forum recently that the county was in default of its leases with the teams right now.

In other words, the county had not fulfilled its obligations to maintain and repair the stadiums, and the teams were no longer contractually obligated to stay in Kansas City. “Technically, legally, they’re free to leave now,â€

If this doesn't pass Tuesday, then this issue is a prime target for a law suit.

One thing that I am still not sure about:  if the vote passes, and the stadiums are in the middle of a renovation on Jan. 1, 2007, does that default on the lease?  In other words, do the renovation have to DONE by 12/31/06 or just be "underway"?

^^^
The new signed agreements take care of this.  No default if the vote passes.
I may be right.  I may be wrong.  But there is a lot of gray area in-between.

i think the more important question might be if the vote fails, and a november issue putting the requried maintinence into the stadia passes, would the county still default on dec 31?

From what I can tell by what people have been saying, the actual work has to be done by then.

Which, to me, makes this whole thing look like a setup by the Legislature.  They waited this long...why?

Sheer, utter incompetence.

So let's vote to allow them to be in charge for the next 25 years!

The new leases would start after the April vote, so the old leases that are in default would go away.  If the vote fails, the work would have to be finished by the deadline.  However, there is nothing stopping the teams from amending the current leases so it's acceptable to at least start the stop-gap work before the deadline.

Anything is possible if the teams agree.

This all comes down to Jackson County voters.  How well do we know Jackson County voters?  Well...

It was the Jackson County voters who elected (and re-elected) the BAD LEADERSHIP that let the county come this close to defaulting on the leases.

This is why I have NO CLUE (one way or the other) how April 4th will turn out.

Well, the problem this time is that the county doesn't know how to be responsible with leases!!!!
